Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NATASHA’S KITCHEN, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, REPRESENTATIVES, VENDORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO ACCESS OR USE THE WEBSITE.
THIS INCLUDES, TO THE EXTENT PERMITTED BY APPLICABLE LAW, CLAIMS ARISING FROM WEBSITE INTERRUPTIONS, TECHNICAL ERRORS, INACCURACIES IN WEBSITE CONTENT, RELIANCE ON RECIPES OR OTHER INFORMATION, AND ACTIVITIES OF THIRD-PARTY SERVICES.
MAXIMUM LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF NATASHA’S KITCHEN AND THE OTHER PARTIES PROTECTED BY THIS SECTION FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE WEBSITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).
THESE LIMITATIONS APPLY REGARDLESS OF WHETHER A CLAIM IS BASED ON CONTRACT, WARRANTY, STATUTE, TORT (INCLUDING NEGLIGENCE), OR ANOTHER LEGAL THEORY, WHETHER OR NOT THE PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND EVEN IF A REMEDY IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE.
NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING CERTAIN CLAIMS IN COURT AND TO PARTICIPATE IN CLASS ACTIONS.
A. Agreement to Arbitrate
To the fullest extent permitted by applicable law, you and Natasha’s Kitchen, LLC (“Natasha’s Kitchen,” “we,” “us,” or “our”) agree that disputes or claims arising out of or relating to your access to or use of NatashasKitchen.com (the “Website”), these Terms, or services provided through the Website will be resolved through binding individual arbitration rather than in court.
This Arbitration Agreement applies to claims involving Natasha’s Kitchen and, to the extent permitted by applicable law, its owners, officers, employees, agents, vendors, advertising partners, and service providers, including claims concerning website data collection, privacy, advertising, and tracking technologies. Each of those persons is an intended third-party beneficiary of this Arbitration Agreement and may enforce it.
The Federal Arbitration Act governs the interpretation and enforcement of this Arbitration Agreement to the extent applicable.
B. Exceptions to Arbitration
This Arbitration Agreement does not prevent either party from:
- Bringing an eligible individual claim in small claims court, provided the claim remains in that court and proceeds on an individual basis.
- Seeking appropriate relief in court concerning infringement or misuse of intellectual property rights.
- Pursuing claims or remedies that applicable law does not permit to be resolved through mandatory arbitration, including public injunctive relief as provided in Section G
Nothing in this Agreement prevents you from filing a complaint with an appropriate governmental or regulatory agency.
C. Informal Dispute Resolution
Before beginning arbitration, the party asserting a dispute must provide written notice describing the dispute, the relevant facts, the party’s contact information, and the relief requested.
The notice must be individualized to one claimant, include the name and email address the claimant used with the Website, and be personally signed by the claimant (and by the claimant’s attorney, if any). We will send any notice to you at the email address we have on file for you.
Notices to Natasha’s Kitchen must be sent by
email to natasha@natashaskitchen.com or by USPS mail to:
Natasha’s Kitchen, LLC, P.O. Box 161, Meridian, ID 83680
The parties agree to attempt in good faith to resolve the dispute informally for 30 days after receipt of the notice. Applicable statutes of limitations and filing deadlines are tolled during that period.
If the dispute is not resolved within that period, either party may initiate arbitration as described below, subject to applicable law.
D. Arbitration Procedures
Arbitration will be administered by JAMS under its applicable rules, including its Consumer Arbitration Minimum Standards when applicable.
Information about JAMS and its rules is available at https://www.jamsadr.com/.
The arbitration will be conducted before a neutral arbitrator. Where permitted by the applicable rules, proceedings may be conducted remotely, through written submissions, or at a reasonably accessible location. Any in-person hearing will take place in the county where you reside unless the parties agree otherwise.
The arbitrator may award any individual relief available under applicable law, subject to lawful limitations contained in these Terms.
Judgment on an arbitration award may be entered in a court of competent jurisdiction.
E. Arbitration Fees
Arbitration fees and costs will be allocated in accordance with the applicable JAMS rules, JAMS Consumer Arbitration Minimum Standards where applicable, and governing law.
Nothing in this Arbitration Agreement requires a consumer to pay fees or costs greater than those permitted under applicable consumer arbitration protections.
If 25 or more similar arbitration demands are filed by or with the assistance of the same or coordinated counsel, the JAMS Mass Arbitration Procedures and Guidelines will apply to the extent JAMS determines they are applicable.
F. Waiver of Jury Trial
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND NATASHA’S KITCHEN, LLC WAIVE THE RIGHT TO HAVE DISPUTES COVERED BY THIS ARBITRATION AGREEMENT DECIDED BY A JUDGE OR JURY IN COURT, EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT.
G. Class-Action Waiver
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND NATASHA’S KITCHEN, LLC AGREE THAT CLAIMS COVERED BY THIS ARBITRATION AGREEMENT WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
Except where applicable law requires otherwise or the parties expressly agree, the arbitrator may not consolidate claims of different individuals or preside over a class or representative proceeding.
If this class-action waiver is determined to be unenforceable with respect to a particular claim or requested relief, that claim or relief (and only that claim or relief) will be severed and decided by a court after the individual arbitration of all other claims, and will never proceed in arbitration on a class, collective, or representative basis.
Any request for public injunctive relief will be severed, decided by a court rather than an arbitrator, and stayed until the arbitrator has decided all individual claims and relief.
H. Authority of the Arbitrator
Except as provided in the next paragraph, the arbitrator will have exclusive authority to resolve disputes within the scope of this Arbitration Agreement, including disputes about its scope, and to award relief available under governing law.
A court will determine any dispute about the formation, existence, validity, enforceability, or unconscionability of this Arbitration Agreement, including the class-action waiver and the public injunctive relief provision in Section G.
I. Severability
If any provision of this Arbitration Agreement is found invalid or unenforceable, that provision will be severed to the extent permitted by law, and the remaining provisions will continue in effect, except where severance would be inconsistent with applicable law or the parties’ agreement.
J. Effective Date and Changes
This Arbitration Agreement takes effect on the date identified below and applies prospectively to disputes and claims arising after that date, to the extent the parties have entered into an enforceable agreement and applicable law permits.
We may amend this Arbitration Agreement in accordance with applicable law. Material changes will take effect no sooner than 30 days after we post them and will not apply to disputes for which written notice has already been received.
Effective Date: October 15, 2026
K. Right to Opt Out
You may opt out of this Arbitration Agreement by sending written notice to [legal@natashaskitchen.com] or to the mailing address in Section C within 30 days after you first accept these Terms. Your notice must include your name, the email address you used with the Website, and a clear statement that you opt out of arbitration. Opting out will not affect any other part of these Terms.
Governing Law
Except as otherwise provided in the Binding Arbitration and Class-Action Waiver section or required by applicable law, these Terms and any disputes arising out of or relating to them shall be governed by the laws of the State of Idaho, without regard to its conflict-of-law principles.
Subject to the Binding Arbitration and Class-Action Waiver section, any action that is not arbitrated, any request for public injunctive relief, and any action to compel arbitration or to confirm, vacate, or modify an award will be brought exclusively in the state or federal courts located in Ada County, Idaho, and you and we consent to personal jurisdiction there. Small claims actions may also be brought in the county where you reside.
Nothing in this section limits rights or protections that cannot lawfully be waived under applicable law.
Changes to These Terms
We may update these Terms from time to time to reflect changes in our Website, practices, or applicable laws.
When we make changes, we will update the “Last Updated” date on this page. We will provide additional notice or obtain agreement where required by applicable law.
Changes will apply as permitted by applicable law and will not automatically alter rights or obligations that cannot lawfully be changed without further agreement.
